1. (1) No person shall, within the City of Durban, ply for hire as a Taxi Driver unless he is in possession of a Taxi Driver's Licence issued in terms of these Bylaws.
(2) No person owning or having the possession or control of any taxi shall employ or in any manner permit any person to drive any such taxi unless such last-mentioned person is in possession of a taxi driver's licence issued in terms of these Bylaws.

1A Nondiscrimination
(1) Subject to the provision of subsection (2) hereof, no provision of these Bylaws shall be applied so as to discriminate between persons on the grounds of race, religion or gender nor shall it be so construed as to have the effect of authorising such discrimination.
(2) Notwithstanding the provisions of subsection (1) hereof, discrimination on the grounds of gender may expressly be authorised in terms of any provisions of these Bylaws which prescribes the wearing of appropriate apparel in a public place or imposes a restriction upon the entry of persons into public ablution, toilet and changeroom facilities or prescribes different standards for such facilities.

2. Application for a Taxi Driver's Licence or the removal thereof shall be made in writing to the Chief Constable in the form prescribed in the First Schedule to these Bylaws and shall disclosed:
(a) The full name of the applicant and address.
(b) The length of the time during which the applicant has been engaged in the business of transporting passengers for reward by taxi.
(c) The length of time during which the applicant has resided and has been so engaged in the City of Durban. (P.N. 212/48; 47/52)
3. An applicant for a Taxi Driver's Licence shall be required to have a thorough geographical knowledge of the City of Durban, and a good general knowledge of the Road Traffic Ordinance No. 21 of 1966 and the Regulations framed thereunder, and the Road Traffic Bylaws for the City of Durban, as amended from time to time.

4. The Chief Constable shall require all applicants to submit themselves to a test of their knowledge as prescribed in Section 3 of these Bylaws.
5. The Chief Constable shall have a discretion to grant or refuse an application for a taxi driver's licence or any renewal thereof, provided he shall not grant any such licence unless he is satisfied that -
(a) the applicant, having regard to his past conduct as a driver of a motor vehicle or otherwise, is a fit and proper person to be entrusted with the driving of a taxi;
(b) the applicant possesses a sufficient knowledge of the matters referred to in Bylaw 3 hereof; and
(c) the applicant is not engaged upon other employment which is likely to affect adversely his general competence or reliability as a taxi driver.

6. If the application for a licence is granted the Chief Constable shall upon payment by the applicant of a fee of R55,00 forthwith issue to him a licence in the form prescribed in the Second Schedule to these Bylaws. Such licence shall, unless cancelled or revoked as in Bylaw 6 (bis) provided, expire on the 31 December in each year.

(bis) A licence to drive a taxi granted in terms of these Bylaws may at any time be suspended or revoked by the Chief Constable upon the ground that -
(a) by reason of his conduct the holder is not a fit and proper person to hold such licence; or
(b) the holder is engaged in other employment which is likely to affect adversely his general competence or reliability as a taxi driver.

7. Any person who -
(a) contravenes any of the provisions of these bylaws; or
(b) makes any statement which he knows to be false for the purpose of procuring, whether for himself or any other person, the grant or renewal of a licence under these Bylaws; or
(c) takes out a licence in any name other than his true name; or
(d) falsely represents himself to be a person to whom a licence has been issued under these Bylaws; or
(e) forges or fraudulently alters or uses or permits any other person to use any licence or certified copy of a licence issued under these Bylaws;
shall be guilty of an offence and shall be liable on conviction to a maximum penalty described for the offence by section 266(7)(a) of the Local Authorities Ordinance No. 25 of 1974. (P.N. 47/52; 369/83)
8. In these Bylaws, unless inconsistent with the content "Taxi" shall mean a public motor vehicle designed or adapted solely or principally for the conveyance of not more than nine persons including the driver. (P.N. 555/81)
